Unfortunately, the failure to provide evidence of the business use of the home office led to the disallowance of home office expenses in this case.
  • Car and Truck Expenses Strict substantiation requirements apply to passenger automobile expenses. Adequate records, including amount, time, place, and business purpose, are essential. Despite providing mileage logs and receipts, the lack of a direct connection to business activities led to the disallowance of deductions for commuting expenses.
  • Depreciation Expenses Sec. 167 allows depreciation deductions, but proper substantiation is necessary. Enhanced substantiation requirements apply to listed property like passenger automobiles. The failure to provide evidence on cost, ownership, and business-related use resulted in the disallowance of all depreciation deductions.
  • Importance of Substantiation and Compliance Proper substantiation and compliance with tax laws are very important to help minimize the risk of legitimate business deductions becoming disallowed by the IRS. We suggest accurate recordkeeping plus organizing and gathering necessary documents throughout the year rather than waiting until year-end.
  • Accuracy-Related Penalties Taxpayers may face penalties for underpayments due to negligence or disregard of rules. Negligence includes failure to keep adequate records. The court imposed accuracy-related penalties on the taxpayer in this case as he failed to substantiate expenses properly.
